Ozark, Missouri Police Department May Have Violated Federal Law With DUI Checkpoint


There was no repeat performance of Ozark, Missouri Police Department's DUI checkpoint on Saturday night as the cold arctic winds blew into Southwest Missouri sending temperatures plummeting. I guess when it comes to violating the Fourth Amendment in the name of safety, the Ozark Missouri Police are a fair weather department.

I decided to do some more research into DUI checkpoints and discovered a Supreme Court decision requires police departments around the country to notify the public seven days in advance where and when they are setting up a DUI checkpoint. Searching the local news sites and the Ozark Police Department Web site, I can't find any evidence of compliance with the Supreme Court Decision by the Ozark Police Department. I called the Ozark Police Department this morning, and they were unable to provide any evidence as well. 

I have contacted Police Chief Lyle Hodges asking for evidence his department notified the public seven days in advance, and I made a friendly offer to purchase Nazi Swastikas for the department to wear on their sleeves if they continue to violate the Fourth Amendment and pull people over without probable cause demanding they show their papers and answer their questions. Simply getting in a car is not probable cause.
