Yesterday's ruling by Federal Judge Henry Hudson is a very important ruling to defeat Obamacare. You see, the part of Obamacare that forces you to participate in Obamacare has been deemed unconstitutional. If you aren't required (forced) to participate in the new healthcare law, then Obama and the Democrats really haven't accomplished much. The law doesn't apply to me. I opt out.
Hudson wrote a beautiful opinion as he stated the federal government has the right to regulate interstate commerce but it doesn't have the authority to force people to engage in commerce, which has always been a valid argument against Obamacare. In his ruling, he wrote the following opinion, which I find to be a beautiful set of words to describe the problem with Obamacare.
The unchecked expansion of congressional power to the limits suggested by the Minimum Essential Coverage Provision would invite unbridled exercise of federal police powers. At its core, this dispute is not simply about regulating the business of insurance – or crafting a scheme of universal health insurance coverage – it’s about an individual’s right to choose to participate.
In other words, Judge Hudson realizes there is an emergence of an American police state, and the healthcare bill isn't about healthcare, rather it's about the expansion of the police state. To have a federal judge realize this and call out the Obama administration and Congress is a big step for freedom-loving Americans who realize the United States is quickly becoming a police state. It gives hope that we can defeat this emergence through conservative common sense.
