Hey Senator Graham, The States Already Have the Power to Reject Obamacare

Why is it Republicans have no clue what the Constitution says despite all their rhetoric claiming dedication to the founding document? Here's an example of what I mean.

Senator Lindsey Graham is going to introduce legislation in the Senate that allows states the power to reject Obamacare. Senator Graham, the states already have that power.

Sens. Lindsey Graham (R., S.C.) and John Barrasso (R., Wyo.) introduced legislation Tuesday that would do considerable damage to the Democratic health-care law by allowing states to ‘opt out’ of its key provisions.

The State Health Care Choice Act would let state governments choose whether or not to participate in various aspects of Obamacare, including: the individual mandate forcing citizens to purchase health insurance or pay a fine, the employer mandate forcing businesses to provide health insurance or pay a fine, the mandated expansion of state Medicaid programs and the federal mandate determining what qualifies as an ‘acceptable’ health-insurance plan.


First off, it's already been ruled by a federal judge the United States government cannot force free American citizens to engage in commerce like the Obamacare law requires for it to be effective. Even if that wasn't the case, the Constitution gives the federal government no authority to create government safety nets like healthcare coverage whether it be Medicaid or Obamacare.

Let me remind Senator Graham why his bill is already the law of the land, and it should be noted and thrown out for Constitutional law, the Supreme Law of the Land.

The Tenth Amendment reads: The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

The Constitution doesn't delegate power to the federal government to provide healthcare. This is a states' rights issue, and the Tenth Amendment already serves for what Graham is trying to do. Wouldn't it be simpler just to state this and enforce this Senator Graham?
